Anti-Spam & Messaging Policy
Rules for sending messages responsibly through Silux Chat.
1. Purpose
This Anti-Spam & Messaging Policy sets out the rules that apply when you use the Silux Chat platform (the "Service"), provided by Silux Control UK Ltd T/A Silux Chat (registered in England and Wales, Chesterfield, S43 3QE, United Kingdom), to send messages to your end users over channels such as WhatsApp, SMS, and email. It forms part of our Terms of Service and Acceptable Use Policy.
2. Consent and Lawful Basis
You are responsible for ensuring you have a valid lawful basis and, where required, the consent of recipients before sending messages through the Service. Marketing messages to individuals generally require prior consent under the UK Privacy and Electronic Communications Regulations (PECR) and the EU ePrivacy rules. Equivalent rules apply in many other countries (for example, the US CAN-SPAM Act and TCPA, Canada's CASL, and similar laws). You must keep records that demonstrate consent where it is relied upon.
3. Prohibited Messaging
You must not use the Service to send:
- Unsolicited bulk or marketing messages to recipients who have not consented where consent is required;
- Messages to purchased, scraped, or rented contact lists;
- Deceptive, misleading, or fraudulent messages, including phishing;
- Messages with false or disguised sender information or misleading subject lines;
- Content that is unlawful, harmful, or that breaches our Acceptable Use Policy;
- Messages that breach the policies of the underlying channel (for example, the WhatsApp Business Messaging Policy).
4. WhatsApp and Channel Rules
Messaging over WhatsApp and similar channels is also subject to the rules of the channel provider, including requirements around opt-in, approved message templates, quality ratings, and the categories of message that may be sent. You are responsible for complying with those rules. We may suspend messaging that puts the platform's channel access at risk.
5. Opt-Out and Unsubscribe
Every recipient must be able to opt out easily. You must honour opt-out and unsubscribe requests promptly (and stop sending further marketing messages without undue delay), and you must not send messages to anyone who has opted out. Where a channel provides a built-in opt-out mechanism, you must respect it.
6. Identification
Messages must clearly identify you as the sender and, where relevant, the purpose of the message. You must not impersonate Silux Chat or any other person or organisation.
7. Monitoring and Enforcement
We may monitor messaging volumes and complaint rates to protect the platform and its channel access. If we reasonably believe your messaging breaches this policy or applicable law, we may throttle, suspend, or terminate your messaging or account, with notice where practicable, and report unlawful activity to the relevant authorities.
